OVERVIEW
Welcome to PURE GRAIN. The terms “we,” “us,” and “our” refer to PURE GRAIN. PURE GRAIN operates this website and online store, including all related information, content, features, tools, products, and services made available through it (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced in them, govern your access to and use of the Services and purchases made from PURE GRAIN.
By accessing or using the Services, or by placing an order, you agree to these Terms. If you do not agree to these Terms, please do not use the Services.
Nothing in these Terms is intended to exclude, restrict, or modify any consumer right or remedy that cannot legally be excluded, restricted, or modified under applicable Canadian or United States law.
SECTION 1 - ELIGIBILITY AND ACCOUNT INFORMATION
By using the Services, you represent that you are at least the age of majority in your province, territory, state, or other jurisdiction of residence, or that you are using the Services with the permission of a parent or legal guardian where required by law.
You agree to provide accurate, current, and complete information when placing an order or creating an account.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring under your account.
SECTION 2 - PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, colours, sizing information, prices, and other product details displayed on the Services are accurate.
Actual colours and appearance may vary depending on your device, screen settings, lighting, manufacturing process, garment dye process, and printing process.
Minor variations in colour, placement, texture, dimensions, or appearance that are normal to the manufacturing or printing process are not necessarily considered defects.
We reserve the right to change product descriptions, pricing, specifications, availability, and product offerings at any time, subject to applicable law.
We may limit quantities or discontinue products without prior notice.
SECTION 3 - ORDERS AND ORDER ACCEPTANCE
Submitting an order through the Services constitutes an offer to purchase products from PURE GRAIN.
Receipt of an automated order confirmation does not necessarily constitute final acceptance of your order. We reserve the right, where permitted by law, to refuse, limit, or cancel an order for legitimate reasons, including:
- product or inventory errors;
- pricing or description errors;
- payment authorization problems;
- suspected fraud or unauthorized activity;
- shipping restrictions; or
- other circumstances that reasonably prevent us from completing the order.
If we cancel an order after payment has been collected, we will refund the applicable amount using the original payment method, unless otherwise agreed or required by law.
Please review your order carefully before submitting it. Some products may enter production shortly after the order is accepted, so changes or cancellations may not always be possible.
SECTION 4 - PRICES, CURRENCY, TAXES, AND PAYMENT
Prices displayed through the Services may vary depending on your selected country or market.
Canadian customers may see prices in Canadian dollars (CAD), and United States customers may see prices in U.S. dollars (USD), depending on the market and checkout settings available through our store.
The currency and final amount payable will be displayed during checkout before you complete your purchase.
Applicable sales taxes, shipping charges, customs duties, import taxes, brokerage fees, or similar charges may apply depending on your location and the destination of the shipment.
You are responsible for any duties, import taxes, customs fees, or other charges imposed by government authorities or carriers unless checkout expressly states that such charges are included.
You represent that you are authorized to use any payment method submitted through the Services.
Prices and promotions may change without notice, but such changes will not affect orders already accepted except where correction is permitted or required by law.
SECTION 5 - SHIPPING AND DELIVERY
We ship to locations made available through checkout, including eligible destinations in Canada and the United States.
Free standard shipping is available on qualifying orders of $75 or more within Canada and the United States.
Any applicable shipping charges for orders that do not qualify for free shipping will be displayed at checkout before the purchase is completed.
Shipping and delivery times are estimates unless expressly stated otherwise. Delivery may be affected by carrier delays, weather, customs processing, holidays, address errors, high-volume periods, or circumstances outside our reasonable control.
Where required by applicable law, if we are unable to ship within the time promised or otherwise within the legally required period, we will provide any notice, cancellation option, refund, or other remedy required by law.
Customers are responsible for providing a complete and accurate shipping address.

SECTION 6 - RETURNS, REFUNDS, AND EXCHANGES
Returns, refunds, exchanges, damaged products, incorrect products, and other order issues are governed by our Refund Policy.
Please review the Refund Policy before completing your purchase.
Nothing in our Refund Policy or these Terms limits any non-waivable rights you may have under applicable consumer protection law.
SECTION 7 - CANADIAN CUSTOMERS
For customers located in Canada, your purchase may be protected by federal, provincial, or territorial consumer protection legislation.
If you are located in Alberta, the Alberta Consumer Protection Act may provide rights and remedies relating to consumer transactions, including internet sales and unfair business practices.
No provision of these Terms is intended to waive or reduce any right, benefit, or protection that cannot legally be waived under applicable Canadian consumer protection law.
SECTION 8 - UNITED STATES CUSTOMERS
For customers located in the United States, your purchase may be protected by applicable federal and state consumer protection laws.
We will make reasonable efforts to ship orders within any timeframe stated at the time of purchase. Where no specific shipment timeframe is provided, we will comply with applicable legal requirements concerning shipment delays, notices, cancellations, and refunds.
Nothing in these Terms is intended to waive any consumer right or remedy that cannot legally be waived under applicable federal or state law.
SECTION 9 - INTELLECTUAL PROPERTY
The Services and their content, including photographs, artwork, graphics, product designs, logos, text, videos, page layouts, and other materials, are owned by, licensed to, or lawfully used by PURE GRAIN and may be protected by copyright, trademark, and other intellectual property laws in Canada, the United States, and other jurisdictions.
You may access and use the Services for personal and non-commercial purposes.
Except where permitted by applicable law or with our prior written consent, you may not reproduce, copy, distribute, modify, publish, sell, license, commercially exploit, or create derivative works from our protected content.
PURE GRAIN names, logos, designs, and brand elements may not be used without permission where such permission is legally required.
SECTION 10 - THIRD-PARTY SERVICES AND LINKS
Our Services may contain tools, applications, links, integrations, or services operated by third parties.
Third-party services may be governed by their own terms and privacy policies.
To the extent permitted by applicable law, PURE GRAIN is not responsible for websites, products, services, or content operated independently by third parties.
SECTION 11 - RELATIONSHIP WITH SHOPIFY
PURE GRAIN is powered by Shopify, which provides the ecommerce technology used to operate our online store.
Products purchased through our store are sold by PURE GRAIN, not Shopify.
Shopify may provide hosting, checkout, payment, security, and other technology services, but PURE GRAIN remains responsible for its products, order fulfillment, and customer service obligations, subject to applicable law.
SECTION 12 - PRIVACY
Our collection, use, processing, and disclosure of personal information is described in our Privacy Policy.
Because our Services are powered by Shopify, certain personal information may also be processed by Shopify and other service providers as described in the Privacy Policy.
SECTION 13 - REVIEWS, PHOTOS, AND OTHER USER CONTENT
If you submit a review, photograph, comment, suggestion, testimonial, or other content to us, you represent that you have the necessary rights to submit that content and that it does not violate applicable law or the rights of another person.
You grant PURE GRAIN a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, distribute, and adapt such content for purposes related to operating and promoting our business and Services, subject to applicable privacy and intellectual property laws.
We may remove content that we reasonably believe is unlawful, fraudulent, misleading, infringing, abusive, or otherwise inappropriate.
SECTION 14 - ERRORS AND INACCURACIES
Occasionally, information on the Services may contain errors or omissions relating to product descriptions, pricing, discounts, shipping charges, product availability, or delivery estimates.
We reserve the right to correct such errors and update information.
If an error materially affects an order you have already placed, we will handle the matter in accordance with applicable law, including providing cancellation or refund rights where required.

You may not use the Services:

We do not guarantee that the website will always operate without interruption, delay, or error.
Nothing in this section excludes any statutory warranty or consumer guarantee that applies to your purchase and cannot legally be excluded.
SECTION 18 - LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, PURE GRAIN and its affiliates, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages resulting from the use of the Services or products purchased through the Services where such damages may lawfully be excluded.
Nothing in these Terms limits or excludes liability where doing so would be prohibited by applicable law.
Nothing in these Terms limits any mandatory consumer protection rights or remedies available to you.
SECTION 19 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless PURE GRAIN from third-party claims, losses, liabilities, and reasonable costs resulting from your unlawful use of the Services, material violation of these Terms, or infringement of another person's legal rights.
SECTION 20 - SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary, without affecting the validity of the remaining provisions.
SECTION 21 - WAIVER AND ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms does not constitute a waiver of that provision.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and other policies expressly incorporated by reference, constitute the agreement governing your use of the Services and purchases from PURE GRAIN.
SECTION 22 - GOVERNING LAW
PURE GRAIN is based in Alberta, Canada. These Terms are generally governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles.
However, if you are a consumer residing outside Alberta, including elsewhere in Canada or in the United States, this governing-law provision does not deprive you of mandatory consumer protections that apply to you under the laws of your province, territory, state, or other jurisdiction of residence.
To the extent legally permitted, disputes relating to these Terms or the Services may be brought before the courts of Alberta, Canada. This provision does not prevent a consumer from bringing a claim in another jurisdiction where applicable law gives that consumer a non-waivable right to do so.

We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements, or other operational reasons.
